Thank you for accessing the Tyger Glyn website. We hope you enjoy the experience of viewing and purchasing beautiful and interesting contemporary jewellery through us.

Tyger Glyn provides the content and services available to you on this website, subject to the following terms and conditions. By using the Tyger Glyn website, you are acknowledging that you have read, understand and agree, without limitation, to be bound by these terms and conditions which also include our Privacy Policy.

From time to time we may modify our terms and conditions to which the content and services available are subject, so we would ask that you review them whenever you access or use our website. Acceptance of these terms and conditions does not affect your statutory rights, except so far as legitimately excluded.

Special offers
Currently we are offering free gift certificates worth £50 each to the first 50 clients to register fully on our website before 24 December 2009. These special gift certificates may be spent towards your first online purchase with Tyger Glyn before 30 March 2010. You may keep them for yourself or give them to a favourite friend. If you are one of the lucky 50, you will be notified by us by email and they will be sent to you in the post. A maximum of two vouchers per household, only one voucher may be used per purchase. They may not be redeemed for cash.

1. REGISTRATION AND ORDERS

1.1 Introduction
You will be able to access most areas of the website without registering your details with us. Certain areas of this website are only open to you if you register.

Additionally some areas are accessible only at the discretion of Tyger Glyn.

1.2 Availability
All products are subject to availability. We will inform you as soon as possible if any items you have ordered are not available.

We will notify you by email as soon as possible to acknowledge receipt of your order. (This is in addition to the email you receive from our secure online payment gateway acknowledging online receipt of your payment details and authorisation to take payment). If we are unable to to fulfil your order following our acknowledgment, we will contact you by email or telephone advising you of this.

A contract between you and Tyger Glyn will come into existence upon us notifying you by subsequent email or telephone that your order has been confirmed and is being dispatched.

You will become liable to make payment for the order at that time. At any point up until then, we may decline to fulfil your order.

If we are unable to supply a particular item or there is a delay in supplying an item for any reason beyond our reasonable control (including but not limited to an item being out of stock, us identifying a description or pricing error or if we are unable to obtain authorisation for your payment) we will not be liable to you.

If we do cancel your contract we will notify you by email or by telephone and will recredit to your account any sum deducted by us from your credit or debit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Risk in the products constituting the orders, will pass to you immediately upon delivery. You will be deemed to have accepted the order unless you notify us upon receipt that the order is incorrect or if you otherwise exercise your cancellation right set out below.

If you fail to act in accordance with these terms, we shall have no obligation to accept a purported rejection exercised by you.

We retain the legal ownership of all products until we have received full payment.

We shall automatically and immediately regain legal ownership of the products in the event that we refund payment to you.

1.3 Payment
We accept most credit and debit cards including American Express but not Diners. Online payments are encrypted and held securely via Universal Payment Gateway and Secure Hosting UPG before being processed by the bank

You can pay over the telephone, in person or via our secure online payment facility. For your own security, please never email your card details.

Any order of products is subject to warranties by the person ordering that:
a) the payment details are valid and correct;
b) the person ordering is the person referred to in the billing information provided;
c) the person ordering may lawfully enter into online contracts, in accordance with the provisions of the laws of England and Wales or, as relevant, any applicable local law.

Payment will be taken from your debit/vcredit card once the availability of what you wish to purchase has been confirmed. In the event of a special order, commission, or bespoke order or alteration to a piece, a 50% non returnable deposit will be taken at time of order and the balance will be payable on confirmation from us that the work is ready to be delivered or collected in person. Such orders are non returnable and non refundable.

In special circumstances we may accept payment by cheque, made out to Tyger Glyn, or by BACS or CHAPS payment but this is at the discretion of Tyger Glyn only. Please discuss this with Tyger Glyn ('the gallery') prior to ordering anything if this is your intention. There may be administrative charges attached. Please note that we will be unable to dispatch your goods until full payment has been received and cleared.

Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

1.4 Tyger Glyn gift vouchers
Gift vouchers ('Gift certificates') are available to purchase and are issued in GBP25, GBP50, GBP100, GBP250, GBP500 and GBP1000 denominations and any multiples thereof. Until further notice, Tyger Glyn gift certificates may only be ordered by telephone or email and paid for in person or by telephone. Each gift certificate is dated, numbered and registered at Tyger Glyn in the purchaser's name. Gift certificates are non refundable and valid for up to 12 months only from the date they were bought. They are not redeemable against cash. They may be used against purchases made in person or online but online purchases to be paid for with gift certificates will, until further notice, require a phone call to the gallery to arrange. They may be used as part payment torwards a more expensive purchase where the balance is made up by credit or debit card payment. If they are not fully spent in one go, the holder of the gift certificate will receive change in the form of a gift certificate or credit note for the value remaining. These will remain valid within the 12 month month period of the original gift certificates.

1.5 Prices
All prices are quoted in Pound Sterling (GBP / £ ). Prices can go up or down. Formal written quotations are valid for 30 calendar days only.

Prices given in any other currency than GBP are only provided as helpful but approximate indications of the equivalent in that currency, of the GBP price. Payment is taken in pound sterling. Exchange rates can change suddenly making your purchase considerably cheaper or more expensive when payment is taken from your account if your own account is in another Currency. We accept no responsibility for the changes in cost to you that these exchange rate changes or bank charges may incur when payment is provided from your bank account.

Prices on the website are indicated by the letter after the code beneath the detail pictures. For exact price, please contact the gallery by phone or by email using the 'Request more info' button next to the piece you wish to know more about.

Prices are VAT inclusive but exclusive of delivery charges.

VAT is charged at the relevant UK rate for the piece. This will be the standard VAT rate at the time of purchase or the lesser margin rate for hand made goods by artists. Tyger Glyn's registered GB VAT number is 888 0623 87.

If the goods are to be delivered outside of the EU, you may qualify to have the VAT removed. In such an event please contact the gallery to arrange. We can adjust the price accordingly or refund you the VAT once proof of export has been received by us from the courier or EU airport of departure. Any import duties or taxes payable in the country or state into which the goods are delivered from the UK, are the responsibility of the purchaser.

1.6 Out of stock Items
We carry many items in stock, however in some instances the original piece featured on the website may no longer be available and a similar piece may need to be specially sourced and ordered for you. Best efforts are made to indicate such a piece in the text below the picture and / or by the Z in the code. If someone is in the process of purchasing the piece online just prior to you, the system will automatically ask you to contact the gallery when you click on the Arrange purchase button. We will make every effort to expedite your special order and be realistic in our estimated delivery time. Please be aware that as your order is being made especially for you, it can take on average two to eight weeks. We will communicate exact times to you by email or phone. Naturally special orders are final orders.

1.7 Commissions
Tyger Glyn will take a non returnable 50% deposit on any commissioned, bespoke or special orders, prior to the order being confirmed. The remaining 50% balance will be payable before delivery. Commissioned work is non returnable.

1.8 Alterations
Tyger Glyn reserves the right not to agree to alter a piece and/or not to sell a piece that would be altered if we believe it would compromise the physical and/ or artistic strength of the piece.

100% payment will be taken up front for any piece or pieces that need altering for size and once altered, these pieces are non refundable.

1.9 Cancellation right

You have the right to cancel your order up to 7 working days after the day following the delivery of the goods, by sending us a notice of cancellation by email or post. You will receive a returns code from us by email, which must be included in the package and sent to us along with the goods you are returning, in their original condition, unworn and in their original packaging within the specified deadline.

 

2. RETURNS POLICY
2.1 How to return an item
We hope that you or whoever you give to, will love your Tyger Glyn purchase and have huge enjoyment from it for many, many years. However, in the unlikely and regrettable event that you should have a change of mind and wish to return the piece, or the person you give the piece to wishes to exchange the piece, this is possible but we have a few normal conditions: A prerequisite for all returns is that they must be returned quickly, unworn, in their original packaging and in resaleable condition. The returned goods must also include a returns code obtained from the gallery.
2.2 Sending items back
Whenever you are thinking of returning anything to us, for refund or exchange, please contact the gallery first to obtain a delivery address and returns code.
Any items sent to us are at the owners' risk and cost and we would recommend posting only by Royal Mail's Special Delivery if within the UK or by trusted courier from outside the UK. It is advised that you maintain your proof of postage until you recieve an email confirmation from us of the safe arrival of your returned goods. Please see below for further details:
2.3 Refunds
Items to be returned for a refund must be sent back to us within 7 calendar days of receipt of goods. Goods must be unworn and in their original condition and packaging. It is essential to contact the gallery before you return anything by post or in person in order to receive a RGC (returned goods code) and the address to return goods to. Anything returned without the code will not be refunded or exchanged. Refunds will only be credited to the original cardholder's credit or debit card.
Please allow up to 14 days from the date we confirm refund approval for your account to be credited.
2.4 Exchanges
Exchanges can be made within 14 days of your receiving your order and depending on stock availability, so long as the original piece is returned to us in perfect and resaleable condition within 14 days. We cannot vouch for stock availabity. Exchanges may also be made for the equivalent sales value in Tyger Glyn gift certificates valid for up to 12 months from date of issue and governed by the terms and conditions of our gift certificates.
2.5 Credit notes
Credit notes are automatically turned into Tyger Glyn gift certificates, valid for 12 months from date of issue. Please read details about our gift certificates.
2.6 Damaged work
In the unlikely event that you receive faulty or damaged goods, you must notify the gallery immediately and return the goods to the delivery address given to you by the gallery along with a Faulty goods return code within 7 days of receiving your order.
All faulty items will be inspected whereupon we will contact you with our decision. Regardless of statutory rights. The arbiter will be the Director of TygerGlyn and in the rare and unlikely event of any dispute will be decided on with the expert eye of the designer maker of the piece.

3. DELIVERY OF GOODS TO YOU
3.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used. All delivery services that we use have a track and trace facility.

3.2 All orders within the UK are delivered using Royal Mail Special Delivery. If no one is there to sign for the parcel, your parcel will be delivered to the local sorting office where it will need collecting within 21 days of delivery. They will put a card through your door giving details of where and when collections can be made.
3.3 Delivery Charges:
For orders over £1500, delivery is free of charge within the UK
For delivery within the UK we charge a flat fee of £7.95 and the delivery will arrive within 1-3 working days of our confirmation that your purchases are ready to be dispatched
Delivery overseas costs £18 to Europe, £25 everywhere else and the delivery will arrive within 1-7 working days from our confirmation to you that your parcel is ready to be dispatched
For urgent same day deliveries within London, we can arrange courier delivery for the fixed fee of £20. Please discuss with the gallery before purchase. Urgent deliveries usually need to have been ordered and paid for before 2pm.

3.4 Please note that working days exclude Saturdays, Sundays and bank holidays.

3.5 Any delivery timescales are indicative only and do not constitute binding obligations on us.

3.6 If you would like to send your order as a gift, you can select the gift wrapping option when you are checking out.

3.7 If you would like us to include a gift message with your purchase we can do so whether or not you choses the gift wrap option. Please provide the wording in the relevant box at checkout.

3.8 For full details about our gift wrapping service please see the gift wrapping section in 'Customer service' page under the 'Useful info' section.

3.9 For security reasons all parcels must be signed for on receipt.

4. CONTENT
We attempt to be as accurate as possible when describing our products and prices on the website.

However, subject to applicable law, we do not warrant that the product descriptions, colours or other content available on the Site are accurate, complete, reliable, current, or error-free.

All prices are displayed inclusive of VAT and exclusive of delivery charges.

5. LIMITATION / EXCLUSION OF LIABILITY
5.1 The Tyger Glyn website is provided to you without warranties or guarantees of any kind whatsoever (express or implied) and your use of our website and its contents is entirely at your own risk.

5.2 In particular, the user must bear the inherent risks associated with the use of the worldwide web. We accept no responsibility or liability for functions contained on our Website and will not be responsible for:

5.3 Any errors or omissions or for any technical problems (including but not limited to worms and viruses) you may experience with the website; incompatibility of the website with any of your equipment, software or telecommunications links.

5.5 Save as expressly stated elsewhere in the Terms and Conditions, we will not be liable to you or any third party for any direct, consequential or incidental loss or damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any indirect loss whatsoever that arises out of or is related to the use of our website.

5.6 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by email of the problem within 7 working days of the delivery of the goods in question.
5.7 If you do not receive goods ordered by you within 7 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by e-mail or telephone at our contact address of the problem within 14 days of the date on which you ordered the goods. If you notify us of a problem under this condition, our only obligation will be, at your option either:
 - to make good any shortage or non-delivery; or
 - to replace any goods that are damaged or defective; or
 - to refund to you the amount paid by you for the goods in question in whatever way we choose.
5.8 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as detailed above.
5.9 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
5.10 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
5.11 We cannot be held responsible for any delays once the goods have left us and are in possession of the courier or Royal Mail.

6. LINKS TO OTHER WEBSITES

6.1Tyger Glyn may, purely as a convenience to its website users, from time to time include links to other web sites or material which are beyond its control.

6.2 Such links are in no way an endorsement by us of the referenced content, product, service, or supplier.

6.3 Should you chose to link to or from any off-website pages or other websites, you acknowledge that this is carried out entirely at your own risk and we will accept no liability to you, howsoever caused in that respect.

7. THIRD PARTY
Third Party Rights: Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

8. VISITOR MATERIAL AND CONDUCT

8.1 We welcome your enquiries, feedback, suggestions and other ideas (collectively "Suggestions") regarding the website or products and services provided by us.

8.2 All Suggestions will be submitted on the understanding that they are non-confidential and non-proprietary to the person or organisation providing them and that they may not be returned to you and that we may not communicate with you in respect of them.

8.3 You also agree and acknowledge that we may use or modify the Suggestions and any ideas, concepts or know-how contained therein without restriction, for any purpose (commercial or otherwise), without acknowledgement or payment to you.

8.4 In providing the Suggestions you agree that you will not misrepresent the origin of the Suggestions and agree to indemnify us for all claims arising from or in connection with any claims in respect of any Suggestion including to any rights therein.

8.5 You are prohibited from posting or transmitting to or from this Website, any material:
a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;

No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.
9.4 You are permitted to use this website for personal purposes only.
9.5 You agree not to use any content of the website for commercial purposes, including but not limited to copying, duplicating, reproducing, storing, selling, reselling, modifying, accessing or otherwise exploiting the content in whole or in part other than as set out above without our prior written consent.

9.7 The copyright of every piece and design shown by Tyger Glyn here on the website and elsewhere, is held by the designer/maker of the piece. We take infringements of our designers' design copyright very seriously and we do not knowingly promote work by any designer whose work infringes the design copyright of another.

10. NOTICES
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address at customerservice@tygerglyn.com or to our postal address of Tyger Glyn, PO Box 18890, London SW7 4NT. All notices from us to you will be displayed on our website from time to time.

11. INVALIDITY
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

12. GOVERNING LAW
Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law. The terms of this charter (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

13. ENTIRE AGREEMENT
13.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions r as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
13.2 We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.

14. EVENTS BEYOND OUR CONTROL
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

15. INTERNATIONAL ACCESS 15.1 Tyger Glyn does not warrant or otherwise promise that the website, use thereof or the Terms and Conditions (in whole or in part) are in compliance with laws or available for use in locations outside the United Kingdom.

15.2 If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

15.3 To the extent that any provision of the Terms and Conditions is unenforceable in such locations, that provision should be struck out and the remaining provisions remain in force.
